Welcome to Mango - Twilio Calls & Texts! These Terms and Conditions ("Terms") govern your use of the Mango - Twilio Calls & Texts mobile application ("App") provided by Code Pharmacy LLC ("we," "us," "our"). By using the App, you agree to comply with and be bound by these Terms. The purpose of these Terms is to establish a legal agreement between you ("user," "you," "your") and Code Pharmacy LLC regarding your use of the App, including all related features and services.

These Terms outline your rights and obligations while using the App and our responsibilities to you. If you are using the App on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.

These Terms apply to all users of the App, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content. By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. APP OVERVIEW

Mango—Twilio Calls & Texts is a mobile application that allows users to make calls and send texts using their Twilio credentials. Developed by Code Pharmacy LLC, the app is convenient for individuals who require a separate line for work or other purposes, leveraging their existing Twilio accounts. By integrating directly with Twilio, Mango offers a seamless communication solution without a traditional phone service.

Mango is currently available on iOS and can be downloaded from the Apple App Store. It is accessible to users worldwide and provides a reliable platform for managing calls and texts through Twilio's powerful API.

3. USER ELIGIBILITY

To use Mango - Twilio Calls & Texts, you must meet the following requirements:

3.1 Twilio Account: To log in and use the app, you must have an active Twilio account with valid credentials, including an Account SID and Auth Token. Ensure that your Twilio account is in good standing and complies with Twilio’s terms of service.

3.2 Device Compatibility: The app is available for iOS devices only. Ensure your device meets the minimum system requirements specified in the Apple App Store. You should also have an internet connection (Wi-Fi or cellular data) to use the app's features effectively.

3.3 Accuracy of Information: When using the app, you are responsible for providing accurate and up-to-date information, including your Twilio credentials and any other required details.

3.4 Age Restrictions: Mango—Twilio Calls & Texts is intended for individuals at least 18 years old. By accessing or using the app, you represent and warrant that you are at least 18.

If you are under 18, you must not use the app. We do not knowingly collect information from individuals under 18. If we become aware that a user under 18 has provided us with personal information, we will take steps to delete such information from our records.

Parents or legal guardians are responsible for ensuring their children do not access or use the app. If a parent or guardian discovers that their child under the age of 18 has used the app or provided personal information, they should contact us immediately to have the information removed.

4. USER ACCOUNT AND CREDENTIALS

Mango—Twilio Calls & Texts requires users to log in using their Twilio credentials. These include your Twilio Account SID and Auth Token, necessary to enable the app’s core functionality of making calls and sending texts. By providing your Twilio credentials, you authorize Mango to access your Twilio account to perform these actions on your behalf.

Upon entering your Twilio credentials, the app will verify the information to ensure it is valid and active. Incorrect or inactive credentials will prevent access to the app's features.

The app integrates seamlessly with Twilio’s API, utilizing your credentials to manage your communications efficiently. This integration allows you to use your Twilio account as if accessing it directly through its platform.

4.2 Responsibility for User Credentials

As a user, you are responsible for maintaining the confidentiality and security of your Twilio credentials as explained below:

• Keep your Twilio credentials. Failure to do so may compromise the security of your Twilio account and the Mango app. Ensure that your Account SID and Auth Token are not shared with others to prevent unauthorized access and potential misuse.
• Ensure your device is secure and protected by a password, PIN, or biometric authentication. Unauthorized access to your device can lead to unauthorized access to your Twilio account.
• If you suspect your Twilio account credentials have been compromised or notice any discrepancies, contact Twilio support immediately. Although we encourage you to inform our support team, we cannot assist you in resolving issues related to your Twilio account as we need administrative control.

5. SUBSCRIPTION TERMS

Mango - Twilio Calls & Texts offers flexible subscription plans to suit your needs. Subscriptions grant you access to all premium features of the app, ensuring seamless and uninterrupted communication.

Weekly Subscription: Our weekly subscription plan allows you to access all the app’s features weekly. This option is ideal for users who need short-term access or prefer to manage their subscriptions weekly.

Quarterly Subscription: Our quarterly subscription plan provides three months of access to the app’s features. This plan offers a longer-term solution and can be more cost-effective for regular users.

5.1 Pricing and Payment

Pricing: The pricing for both the weekly and quarterly subscription plans is clearly stated within the app and on the Apple App Store page. Prices may vary depending on your location and any applicable taxes.

Payment: Payments are processed through your Apple ID account, ensuring secure and straightforward transactions. Upon purchase confirmation, your Apple ID account will be charged for the selected subscription plan.

5.2 Free Trial Period (if applicable)

Free Trial: Mango—Twilio Calls & Texts may offer a free trial period for new users. The duration of the free trial will be specified within the app. You can access all the app's premium features during the free trial without any charge.

Transition to Paid Subscription: At the end of the free trial period, your chosen subscription plan (weekly or quarterly) will automatically commence, and your Apple ID account will be charged accordingly. If you do not wish to continue with a paid subscription, you must cancel the subscription before the end of the free trial period.

3. Automatic Renewal

Renewal Terms: All subscriptions are set to automatically renew at the end of the current billing period (weekly or quarterly) unless you cancel the subscription. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.

Managing Renewals: You can turn off automatic renewal anytime through your Apple ID account settings. To avoid unwanted charges, ensure that any changes to your subscription settings are made before the renewal date.

5.4 Cancellation and Refund Policy

Cancellation: You can cancel your subscription anytime through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. You will retain access to the app’s premium features until the subscription expires.

Refunds: As subscriptions are managed through Apple, all refund requests must be directed to Apple Support. We are unable to process refunds directly. Apple’s terms and conditions govern refund policies. Please refer to Apple’s support documentation for more information on refund requests.

6. USE OF THE APP

6.1 Permitted Uses: Mango - Twilio Calls & Texts is designed to provide users with a reliable platform for making calls and sending texts using their Twilio credentials. Permitted uses of the app include:

• Making voice calls through your Twilio account.
• Sending SMS messages via your Twilio account.
• Using the app for personal communication needs.
• Utilizing the app for professional purposes, such as managing work-related calls and texts, providing customer support, or handling business communications.
• Accessing and managing your Twilio account settings as needed for the app's functionality.
• Manage your subscription options, switch between weekly and quarterly plans, and handle billing through your Apple ID account.

By adhering to these permitted uses, you ensure that Mango - Twilio Calls & Texts is used in accordance with its intended purpose and functionality.

6.2 Prohibited Uses: To maintain the integrity and security of the App, the following activities are strictly prohibited:

• Using the app for any illegal activities, including but not limited to fraud, harassment, spamming, or malicious conduct.
• Attempting to gain unauthorized access to other users’ Twilio accounts or the app’s backend systems.
• Using the app to access or attempt to access any unauthorized areas of Twilio's network or systems.
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
• Using the app to transmit any content that contains viruses, malware, or any other harmful or destructive code.
• Engaging in any activity that disrupts or interferes with the app's performance, servers, or networks connected to the app.
• Using the app for commercial purposes not intended by the app, such as selling access to it or its features to third parties without our explicit permission.
• Using the app to infringe upon the intellectual property rights of others, including trade secrets, copyrights, or other proprietary rights.

6.3 Compliance with Laws: Users of Mango - Twilio Calls & Texts must comply with all applicable local, state, national, and international laws and regulations. This includes, but is not limited to:

• Ensuring that all communication and data handling practices comply with relevant data protection and privacy laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable legislation.
• Adhering to all relevant telecommunications regulations and guidelines that govern the use of voice and text communication services.
• Comply with anti-spam laws, including the CAN-SPAM Act, and refrain from sending unsolicited messages violating such laws.
• Ensuring the app complies with applicable export control and sanctions laws and is not used to transmit or handle data violating such laws.

Mango - Twilio Calls & Texts integrates seamlessly with Twilio's powerful communication platform to provide users with a robust solution for making calls and sending texts. By leveraging Twilio's API, Mango allows users to manage their communication needs directly through the app, utilizing their existing Twilio account.

7.1 Key Integration Features

Voice Calls: Mango uses Twilio's voice API to enable users to make high-quality voice calls.

SMS Messaging: The app employs Twilio's messaging API to send and receive messages.

7.2 Role of Twilio Credentials

Users must provide their Twilio credentials, specifically their Account SID and Auth Token, to utilize Mango's features. These credentials are essential for authenticating with Twilio's API and enabling the app to perform the following functions:

• Your Twilio Account SID and Auth Token authenticate your identity with Twilio's servers, allowing Mango to access and utilize your Twilio account.
• The credentials provide the necessary permissions for Mango to interact with Twilio's API, enabling call initiation, SMS sending, and other communication functions.
• The app uses your credentials to securely communicate with Twilio's servers, ensuring that your calls and texts are handled efficiently and securely.

To ensure the Mango app works correctly, we may need to modify certain settings in your Twilio account. Specifically, we may set Mango app webhooks to your Twilio phone numbers. This configuration allows the app to handle incoming and outgoing calls and texts through your Twilio account.

Webhook Configuration: When you use the Mango app, we will configure webhooks in your Twilio account to point to the Mango app. This setup is necessary for the app to function as intended.

These changes to your Twilio settings are required for the Mango app to function properly and provide the calling and texting services you expect.

7.4 Disclaimer of Liability Related to Twilio

While Mango - Twilio Calls & Texts integrates with Twilio to offer its communication services, it is important to note the following disclaimers regarding liability:

• Mango and Twilio are independent entities. Integrating Twilio's API into Mango does not create any partnership, joint venture, or agency relationship between Code Pharmacy LLC and Twilio.
• Twilio's terms and conditions also govern your use of Twilio's services through Mango. It is your responsibility to review and comply with Twilio's terms of service, which can be found on Twilio's website.
• Code Pharmacy LLC is not responsible for issues, outages, or service interruptions that originate from Twilio's platform. Any problems related to Twilio's services must be addressed directly with Twilio.
• Code Pharmacy LLC is not liable for any damages, losses, or expenses arising from using Twilio's services, including but not limited to issues related to call quality, message delivery, or account security.
• Users are responsible for ensuring that their use of Twilio's services through Mango complies with all applicable laws and regulations. This includes but is not limited to, data protection laws, telecommunications regulations, and anti-spam legislation.

By using Mango—Twilio Calls & Texts, you acknowledge and accept these disclaimers, understanding that Code Pharmacy LLC cannot be held liable for any issues related to Twilio's services. For any concerns or issues directly related to Twilio, please get in touch with Twilio support.

8. USER RESPONSIBILITIES

As a Mango - Twilio Calls & Texts user, you must ensure that all information you provide is accurate, current, and complete. This includes but is not limited to, your Twilio credentials and any other data required to use the app.

8.1 Twilio Credentials: Ensure that your Twilio Account SID and Auth Token are correctly entered into the app. Incorrect or outdated credentials may prevent you from accessing the app’s features.

8.2 Personal Information: If the app requires personal information, such as contact or payment information, you must provide accurate and up-to-date data to facilitate smooth operations and communications.

8.3 Updates: Regularly review and update your information as needed to maintain the accuracy of your account details.

By providing accurate information, you help ensure the smooth functioning of the app and avoid potential service disruptions.

8.4 Responsible Use of the App: Using Mango - Twilio Calls & Texts responsibly is essential to maintaining a safe, lawful, and enjoyable environment for all users. Responsible use includes adhering to the following guidelines:

• Do not engage in any prohibited activities under these Terms, including unauthorized access, illegal activities, and the distribution of harmful content.
• Use the app in a manner that does not disrupt or interfere with the performance of the app, servers, or networks connected to the app. Excessive use that affects other users’ experiences is prohibited.

Maintaining the security of Mango - Twilio Calls & Texts is a shared responsibility between Code Pharmacy LLC and its users. If you encounter any security issues or vulnerabilities, it is crucial to report them promptly.

Identifying Issues: Identify potential security issues, such as unauthorized access, data breaches, or suspicious activity related to your Twilio account or the app.

Immediate Reporting: Report any identified security issues immediately to our support team. Please provide as much detail as possible to help us understand and address the problem efficiently.

This content is protected by copyright and other intellectual property laws.

9.1 Copyright: The entire content of the app is protected under copyright laws. Users may not copy, reproduce, distribute, or create derivative works from any part of the app’s content without prior written permission from Code Pharmacy LLC.

9.2 Software: The software that operates the app is the property of Code Pharmacy LLC or its licensors. Unauthorized use, modification, or distribution of this software is prohibited.

9.3 Limited License to Use the App

By using Mango - Twilio Calls & Texts, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the app for personal and professional communication purposes, in accordance with these Terms and Conditions set forth:

• This license allows you to use the app on compatible iOS devices you own or control solely to make calls and send texts using your Twilio account.
• Your use of the App must comply with all applicable laws and regulations and not infringe on the intellectual property rights of Code Pharmacy LLC or any third party.
• Code Pharmacy LLC reserves the right to revoke your license to use the app at any time, without notice, for any reason, including but not limited to violating these Terms and Conditions.

9.4 Restrictions on Use of Content

To protect the intellectual property rights of Code Pharmacy LLC and its licensors, the following restrictions apply to your use of the content within Mango - Twilio Calls & Texts:

• You may not copy, reproduce, distribute, or transmit any content from the app without prior written permission from Code Pharmacy LLC.
• You may not modify, adapt, translate, or create derivative works based on the app or content.
• You may not reverse engineer, decompile, or disassemble any software or other components of the app.
• You may not use any content from the app for commercial purposes without prior written consent from Code Pharmacy LLC.
• You may not remove, alter, or obscure copyright or other proprietary rights notices on the app or its content.

9.5 Permitted Uses: You may use the app's content as expressly authorized by Code Pharmacy LLC in accordance with these Terms and Conditions.

9.6 User-Generated Content: Any content you generate while using the app (e.g., call logs, text messages) remains your property, but by using the app, you grant Code Pharmacy LLC a limited license to use, store, and process this content as necessary to provide the app’s services.

10. TERMINATION

Code Pharmacy LLC reserves the right to terminate or suspend your access to Mango - Twilio Calls & Texts at any time, without notice, for any reason, including but not limited to violation of these Terms and Conditions, non-payment of subscription fees, or conduct that we believe is harmful to other users, our business interests, or the app’s integrity.

Immediate Termination: Your access to the app may be terminated immediately if you are engaged in activities that violate the Terms and Conditions, such as unauthorized access, illegal activities, or misuse of the app.

Notice of Termination: We will provide notice of termination via email or within the app. However, we may terminate access without prior notice for severe violations.

Discretionary Termination: Code Pharmacy LLC has the sole discretion to determine whether a user’s conduct warrants termination of access.

10.1 Effect of Termination

Upon termination of your access to Mango - Twilio Calls & Texts, the following effects will take place:

• You will immediately lose access to all the app's features and functionalities. This includes making calls, sending texts, and managing your Twilio account through the app.
• Any data associated with your use of the app, such as call logs and messages, may be retained in accordance with our Privacy Policy. However, you can no longer access this data through the app.
• Your subscription will be canceled, and you will not be charged for subsequent billing periods. If termination occurs before the end of a billing period, you may not be entitled to a refund for the remaining portion of the subscription term, subject to our Cancellation and Refund Policy.
• The limited license granted to you to use the app will be revoked, and you must cease all app use immediately.

10.2 Reinstatement of Access

In some cases, access to Mango - Twilio Calls & Texts may be reinstated at the discretion of Code Pharmacy LLC. If you believe your access was terminated in error or if you have rectified the issue that led to termination, you may request reinstatement of access as set forth:

• To request reinstatement, contact our support team with a detailed explanation of the situation and any steps you have taken to resolve the issue.
• Our support team will review your request and determine whether to reinstate your access. This process may include verifying your compliance with these Terms and Conditions and ensuring that any outstanding issues have been resolved.
• Code Pharmacy LLC has the sole discretion to decide whether to reinstate access. If your request is approved, you will receive an email notification and regain access to the app. You will be explained if your request is denied, and the termination will remain in effect.

10.3 Continued Compliance: You must comply with all Terms and Conditions if your access is reinstated. Any further violations may result in permanent termination without the possibility of reinstatement.

11. DISCLAIMERS AND LIMITATION OF LIABILITY

Mango—Twilio Calls & Texts is provided on an "as-is" and “as available" basis, without express or implied warranties or representations. Code Pharmacy LLC makes no warranties or representations regarding the accuracy, reliability, completeness, or timeliness of the app or its content.

Functionality and Performance: We do not warrant that the app will operate error-free or uninterrupted or that defects will be corrected.

Compatibility: We do not warrant that the app will be compatible with all devices or operating systems.

Third-Party Services: We do not warrant the availability, accuracy, or reliability of any third-party services, including Twilio's services, which are integrated into the app.

11.1 Limitation of Liability

To the maximum extent permitted by law, Code Pharmacy LLC and its affiliates, directors, officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use Mango - Twilio Calls & Texts.

Basis of Bargain: This limitation applies whether the damages arise from breach of contract, tort (including negligence), or otherwise, even if Code Pharmacy LLC has been advised of the possibility of such damages.

Third-Party Actions: Code Pharmacy LLC is not liable for the conduct or content of third parties, including other app users or providers of third-party services.

Force Majeure: Code Pharmacy LLC shall not be liable for any failure to perform its obligations under these Terms and Conditions where such failure results from any cause beyond its reasonable control, including but not limited to acts of nature, war, terrorism, or governmental actions.

11.2 Indemnification

You agree to indemnify, defend, and hold harmless Code Pharmacy LLC and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of Mango - Twilio Calls & Texts violates these Terms and Conditions or applicable law.
• Any content you submit, transmit, or display through the app, including but not limited to user-generated content, messages, or communications.
• Any claims or actions brought by third parties arising from your use of the app or violating these Terms and Conditions.
• Your failure to comply with applicable laws or regulations related to your app use.

Code Pharmacy LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In this event, you will cooperate with Code Pharmacy LLC to assert any available defenses.

12. MODIFICATIONS TO TERMS AND APP

Code Pharmacy LLC reserves the right to modify, amend, or replace these Terms and Conditions at any time, in its sole discretion. Any changes to these Terms and Conditions will become effective immediately upon posting the revised version on the Mango - Twilio Calls & Texts app or website. Your continued use of the app after posting any changes constitutes your acceptance.

Scope of Modifications: Modifications may include changes to subscription terms, pricing, features, or any other aspect of the app’s functionality or services.

No Obligation to Notify Individually: Code Pharmacy LLC is not obligated to notify users of changes to these Terms and Conditions individually. You must review these Terms periodically to stay informed of any updates.

When modifications to these Terms and Conditions are made, Code Pharmacy LLC may provide notice through one or more of the following methods:

12..2 Continued Use After Modifications

Your continued use of Mango - Twilio Calls & Texts after the effective date of any modifications to these Terms and Conditions constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue using the app and terminate your account as set forth below:

• If you do not agree with any changes to these Terms and Conditions, you can terminate your use of the app and request account deletion.
• These Terms and Conditions changes may affect your subscription terms, pricing, or billing cycle. You are responsible for reviewing these changes and adjusting your subscription preferences accordingly.
• Unless explicitly stated otherwise, changes to these Terms and Conditions will not apply retroactively to disputes or claims that arose prior to the effective date of the revised Terms.

By continuing to use Mango - Twilio Calls & Texts after modifications to these Terms and Conditions, you acknowledge and agree to abide by the updated terms as set forth by Code Pharmacy LLC.
